Pre-order terms.

FireKeep manufactures in limited batches against pre-orders. When you place a pre-order, you are committing to receive a unit from the first production run at a guaranteed price. Pre-order funds go directly to parts, tooling, manufacturing, and regulatory filings — they make the product real. Pre-orders are firm orders, not deposits.
1. What a pre-order is (and what it isn't)
A FireKeep pre-order is a contract for the future delivery of a physical product from a limited production run. You're committing today to receive a unit that we will manufacture and deliver. The price you lock in today is the price you pay — even if our retail price rises before shipment.
A FireKeep pre-order is not:
- An investment. You are not buying equity, shares, options, debt, profit-share, or any other financial security in FireKeep Tools. There is no expected financial return beyond receiving the product itself.
- A donation. We are obligated to deliver the product within the timeframe set out below.
- A loan. You are not extending us credit.
- A general-purpose deposit. Pre-orders are firm orders. They are not refundable on a change-of-mind basis.
2. Twelve-month delivery commitment
This is the most important sentence on this page: FireKeep commits to delivering your unit within twelve (12) months of your pre-order date.
If we fail to deliver your unit within twelve months, you are entitled to a full refund of the amount you paid (less any non-refundable payment-processing fees retained by Stripe — typically about 2.9% + $0.30 per order — which Stripe does not return on refunds and which we have no ability to recover). Email [email protected] after the twelve-month mark with your order number and we will process the refund within five business days.
You will receive what you paid for. Limited first-run units may differ from later production runs in finishing details, packaging, or accessory bundles — but each will be a fully functional, FDA-compliant FireKeep tool that meets the published specifications for its tier.
3. Why pre-orders are firm
Pre-order funds are not held in escrow. The moment you order, your money is at work — buying laser diodes, paying our contract manufacturer's MOQ, funding FDA Form 3632 filing, paying for safety glasses inventory, and covering tooling costs. A change-of-mind refund policy would prevent a small founder-led company from committing to manufacturing at all, because every refund risk would have to be held in cash reserve.
That tradeoff — no general refunds in exchange for being able to actually manufacture — is the deal. The twelve-month delivery commitment is what we put on the line in return.
The standard 30-day return policy after delivery still applies (see Returns & Warranty) — that's a different protection covering the unit itself once you have it. Manufacturing defects are covered by warranty; arrival damage is covered by carrier insurance.
3. Production threshold
FireKeep does not manufacture units until pre-order revenue covers the production run. The threshold is the total of: parts cost × target unit count + manufacturing cost × target unit count + shipping reserve × target unit count + fixed launch costs (FDA filings, Health Canada notification, trademarks, tooling).
FireKeep tracks production-readiness internally. We do not manufacture units until firm pre-orders cover the parts, manufacturing, and regulatory filings for the production run.
If the threshold is not reached within 18 months from pre-order open, we will automatically refund every pre-order in full and discontinue the project. You don't have to ask.
4. Estimated shipping windows
Each tier has a target delivery quarter, displayed at the time of pre-order:
- Watchman (5W) — Q3 2026
- Warden (10W) — Q3 2026
- Keeper (20W) — Q4 2026
- Photon (limited) — Q4 2026
- Outrider, Edge, Anthem — 2027 (specific quarters at product launch)
- Solis (solar panel) — Q3 2026
These quarter-level dates are targets within the twelve-month commitment. Hardware production has real-world delays (CM queue conflicts, certification re-tests, supply-chain issues). If your tier slips beyond its target quarter, we email you with the new estimate as soon as we know. The twelve-month delivery commitment in §2 still governs — if we miss that, the refund mechanism activates.
5. Order priority & serial-number assignment
Within each tier, units ship in order of pre-order date. Serial numbers are assigned at production time in the same order. So pre-ordering early gets you a low serial number — which matters more for collectors than for everyday users, but it's a real benefit.
FireKeep 55 Founder slots have separate priority — those founders ship first within their respective tier, in slot-claim order. If you're a Founder, your serial number falls in the 1–50 range for your unit (Keeper Founder Edition).
6. Price guarantee
The price you pay at pre-order is the price you pay, period. If we raise our retail price between your order and your shipment (which we likely will — pre-order pricing is typically below retail), you keep the lower price.
The reverse: if we lower the price between your order and shipment, we'll automatically refund the difference. We don't make people who ordered first feel punished.
7. Discontinuation, force majeure
If we are unable to deliver due to circumstances beyond our control — including but not limited to: regulatory action that prohibits a product from being sold (e.g., FDA changing Class IV restrictions), war or sanctions affecting supply chains, natural disasters affecting our manufacturing partner, or the founder's incapacitation — the twelve-month delivery commitment in §2 governs. If twelve months pass without delivery, your refund right under §2 applies.
If we voluntarily discontinue a product before twelve months have elapsed, we will proactively offer either: (a) a switch to a different FireKeep tier of equal or greater value, or (b) a refund of the amount paid less Stripe processing fees. You choose.
8. Risk acknowledgement
FireKeep is a small Canadian company building a hardware product for the first time. Hardware launches have inherent risk — manufacturing delays, certification challenges, parts shortages. We do everything we can to manage that risk:
- Threshold structure: we don't begin manufacturing until pre-order revenue covers the run.
- Twelve-month delivery commitment is the contractual floor on delivery time.
- We publish the threshold tracker so you can see progress any time.
- Limited first-run units are intentionally scoped — finishing details may differ from later-run units, but every unit meets published specs and ships fully compliant.
By placing a pre-order, you commit to receive a unit and acknowledge that pre-order funds are deployed immediately to manufacture the run. You agree that change-of-mind cancellations are not available, and that the twelve-month delivery commitment is the sole refund pathway for unfulfilled orders.
