Terms of Service.

These Terms govern your use of firekeep.ca and any FireKeep product you order. Plain language, then the precise version. By using the site or placing an order, you agree to them.
1. Who we are
"FireKeep", "we", "us" and "our" refer to FireKeep Tools Inc., a sole-proprietorship operating in British Columbia, Canada (transitioning to incorporated entity Q3 2026). Mailing address: 1234 Vancouver, BC, Canada. Contact: [email protected].
2. Acceptable use of the site
You agree to use firekeep.ca lawfully. Don't try to break into our systems, scrape at unreasonable rates, copy our copyrighted content for resale, or impersonate FireKeep staff. We reserve the right to refuse service to anyone for any lawful reason.
3. Age requirement
You must be 18 years of age or older to use this site or buy our products. FireKeep sells Class IV laser products, which are restricted to adults under FDA, Health Canada, and most state/provincial laws. By placing an order, you represent that you are of legal age and have the legal capacity to contract.
4. Orders & pricing
Prices are in US dollars unless otherwise stated. We accept payment via the methods displayed at checkout (Stripe, currently Visa / Mastercard / American Express / Apple Pay). All sales are final at the moment your unit ships, subject to our Returns policy.
We reserve the right to refuse, limit, or cancel orders — including without limitation orders that appear to be for resale, fraudulent, or shipping to a jurisdiction where Class IV laser products are restricted. If we cancel your order, we'll refund you in full.
5. Pre-orders
Most FireKeep products are sold via pre-order before manufacturing. Pre-orders are firm orders, not deposits — funds are deployed immediately to manufacture the production run, and change-of-mind cancellations are not available. In exchange, FireKeep commits to deliver your unit within twelve (12) months of order date. If we miss that, you receive a full refund less Stripe processing fees. See the full Pre-order terms.
Pre-orders are not securities, investments, or equity. You're paying for a unit at a guaranteed price, not buying a stake in the company. There is no profit-share, dividend, or expected return beyond the product itself.
6. Product safety & legal use
FireKeep products contain Class IV laser diodes regulated under 21 CFR 1040.10 (US) and the Radiation Emitting Devices Act (Canada). When you receive your unit, you agree to:
- Wear OD4+ safety glasses (included with every unit) whenever the laser is on.
- Never aim at people, animals, vehicles, or aircraft. Aiming a laser at an aircraft is a federal crime in both the US and Canada.
- Use the interlock keys. The unit cannot fire without a key inserted.
- Use only for fire-starting and signaling. Not as a weapon, toy, or entertainment device.
- Comply with local laws. Some jurisdictions (California, Massachusetts, New York; Australia, Germany, China, UK, and others) restrict or prohibit Class IV laser products. You're responsible for confirming legality in your location.
7. Warranty
Each FireKeep unit comes with a written limited warranty against manufacturing defects: 2 years on body + electronics, 6 months on the laser diode. The Keeper tier includes a lifetime body warranty. Full terms in the warranty card shipped with each unit and at Returns & Warranty.
Warranty does not cover damage from misuse, modification, water immersion beyond IPX5, drops beyond 1.2 m, attempted disassembly, or use in a jurisdiction where Class IV products are prohibited.
8. Limitation of liability
To the maximum extent permitted by law: FireKeep's liability for any claim related to a product or this site is limited to the amount you paid for the relevant product. We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, lost data, or personal injury caused by misuse.
Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable consumer-protection law (including the Canadian Consumer Protection Acts in your province and US state-level consumer protections). British Columbia law specifically preserves your statutory consumer-protection rights regardless of these terms.
9. Dispute resolution
If something goes wrong, please email us first at [email protected]. We answer every email and we'd genuinely rather solve a problem with you than fight about it.
If we can't resolve it through email, these terms are governed by the laws of British Columbia, Canada, and any formal dispute will be heard in the courts of British Columbia. If you're a US consumer, the Federal Arbitration Act may also apply; we waive any requirement that you arbitrate before suing in small-claims court for amounts under $10,000.
10. Changes to these terms
We may update these Terms periodically. Material changes — anything that reduces your rights — we'll email you about (if we have your email on file) at least 14 days before the change takes effect. Continued use of the site after the effective date constitutes acceptance.
The "Last updated" date at the top of this page reflects the most recent revision. Old versions are kept on request.
